Calling Time on the Statutory Disciplinary & Grievance Procedures!
Businesses should be counting the days down until the 6 April 2009 as this is the joyous day that the unworkable and ridiculous Statutory Disciplinary & Grievance procedures will be consigned to the statute bin for ever….
Butt only after they caused over 4 years of hardship to employers and employees alike with their prescriptive nonsense which resulted in more litigation not less, as well as findings of unfair dismissal against employers who had watertight and perfectly justifiable reasons for dismissing individuals. There are a number of changes, particularly in relation to the disciplinary procedures. If any disciplinary action is taken by an employer prior to 6 April 2009 then the “old regime” applies.

about time and 4 years too late…thank you Mr Blair and chums for acceding to Union pressure and bringing in legislation that was poorly thought out and actually led to more litigation not less for businesses…thank you very much for preventing businesses from dispensing with employees quickly when they have good cause to do so and tying up businesses in months of grievance procedures by employees and Unions with no real gripes but simply to abuse the system and drag out processes and allow employees to have full pay whilst suspended for serious offences

only 4 years to repeal a system which was clearly unworkable from the outset…goodness knows how much this has cost UK businesses in protracted grievance & disciplinary procedures…problem is the new laws simply retain the old regime but in a non-codified form so I

Anon…yes new system is non-codified but at least we can go back to the argument under “Polkey” that any errors or slight technical failings would have made no difference to the decision…the prescriptive minutae under the old system was palpable nonsense and good riddance I say…now we just need to repeal TUPE and we’re getting somewhere
